Privacy

The collection and use of personal information by Taranaki Regional Council is regulated by the Privacy Act 2020. Under this Act, personal information may be collected only for a lawful purpose connected with a function or activity of the council and only if necessary for that purpose. Such information must, as a general rule, be collected directly from the individual concerned and that person must be told why the information is needed.

The Taranaki Regional Council will use personal information provided by website visitors, or those contacting the Council via social media, only for the reasons it was given. The only use we make of personal information (usually email addresses) is to respond to queries arising from our website or our social media channels. We do not otherwise make use of personal information, nor do we provide it to third parties unless written permission is given by the website visitor concerned.

Environmental data terms & conditions

Environmental data (see below) is made available on this website for you to view and download. It is the highest quality data the Taranaki Regional Council is currently able to provide. Some or all of the data being provided may not yet have been audited, however, and is therefore subject to change.

As we endeavour to continuously improve our products, we also reserve the right to further amend data where necessary and without notice at any time. As a result, the information supplied to you now may not be the same as that subsequently produced for you or any other requestor.

While the Council has exercised all reasonable skill and care in controlling the contents of the information, you should independently check the information provided if the accuracy of that information is important to you.

Under no circumstances will the Council, its employees or agents be liable in contract, tort or otherwise to compensate you for any loss, injury or damage (including loss of profits or consequential loss) arising directly or indirectly from the supply by the Council or its agents of inadequate, inaccurate or incorrect environmental data.

Any use of the material supplied, for example, by inclusion in a report or a media release, should be accompanied by an acknowledgment of the source of the data. We also request that any outputs generated through the use of the information provided be provided to the Council.

Online payments terms & conditions

Before your payment can be processed, you must accept the following terms and conditions:

Acceptance

By using the Taranaki Regional Council online payment service you have agreed to accept the terms and conditions applying at the time you complete the transaction

Service providers

The service available through this website is provided by BNZ Partners and Datacom in agreement with Council. You do not have to be a BNZ customer to use this service.

Fee payable

Fees of 1.25% (GST inclusive) plus 10 cents per transaction are applied to the amount payable to Council to cover Council’s costs. Council does not retain any part of these fees as they are processing fees paid to BNZ and Datacom. These fees appear separately on your receipt.

Other fees or charges may apply as this transaction is carried out in terms of the arrangement between your card issuer and yourself. It is your responsibility to ascertain what if any fees there are.

If payment is made using a credit/debit card issued outside New Zealand, any currency conversion will be done according to the terms and conditions of the card and there may be additional fees charged by your card issuer.

Payment made to Taranaki Regional Council

Council will receive only transaction data that enables payment to be made to your Council account. If your payment is not successfully processed due to credit/debit card or other issues your payment liability to Council will remain outstanding. If your payment liability remains outstanding you may be subject to debt collection penalties, interest and other charges. Fulfilment of your-rates-and payment obligations are your sole responsibility.

If you select an amount to be paid to Council and this payment is accepted but it is later found that the amount paid is insufficient, you remain liable to Council for the balance.

Payment cannot be changed

You must carefully check all information you input into the Council online payment service, to ensure it is correct before you confirm the transaction can proceed. You will not be able to change it once it has been submitted.

Datacom and Council will have no liability for transactions that are incorrect as a result of inaccurate information provided by you or for any loss of information caused by factors outside the control of Datacom or Council. This includes any information supplied by you as part of an application to Council.

Refunds

Refunds, if any, will be at the entire discretion of Council and will be made as Council determines. Any refunds made will be for the invoice amount and will not include the fees charged for the initial transaction.

Security

If you have a user account for Council's online applications, you are entirely responsible for maintaining the security of your login ID and password and for all activity that occurs on or through your account. You must change your password immediately if you believe that your login ID and password have been used without authorisation and you must advise Council of this. Council will not have any liability for any unauthorised use of your account nor of your failure to comply with these obligations.

Your privacy

Any personal information you input into this website is being collected by BNZ, Datacom and Council to enable your payment transaction to Council to be completed. It will be held by BNZ and Datacom as a record of the transaction and may also be used by BNZ and Datacom to create a statistical picture for BNZ and Datacom and for Council of the Council clients using this service.

BNZ, Datacom and Council will take steps to ensure your personal information is held securely. You may, in accordance with the Privacy Act 1993, request access to, and correction of, all personal information held by Datacom/BNZ by contacting the Datacom/BNZ Privacy officer. See:

No warranty

BNZ, Datacom and Council make no warranty, express or implied, and do not assume any legal responsibility:

  • That the website or the server are free from computer viruses or any other harmful components, defects or errors
  • That any defects in the website can be corrected
  • That your access to the website will be reliable, without interruption, deletions, defects, computer viruses or communication line failures or
  • For any theft, destruction, damage or unauthorised access to your computer system or network.

New Zealand law

The Council online payment service is governed by New Zealand law, and the New Zealand Courts have exclusive jurisdiction in relation to it. The Council online payment service has been prepared in accordance with New Zealand law. If you access the Council online payment service from outside New Zealand, you do so at your own risk and are responsible for ensuring compliance with all laws in the place where you are located.

Right to suspend, alter or cancel service

Council will be entitled at any time and without prior notice to you to suspend, alter or cancel the online payment service.
